More residential deals not getting done

Nearly one-third of real estate agents nationwide faced contract cancellations last month

What?s behind the unusually high rate of contract cancellations and settlement delays in the real estate market? With signs of recovery emerging in many parts of the country, shouldn?t deals be zipping along with minimal complications?

Apparently not. Nearly one-third of real estate agents in a new national survey reported experiencing contract cancellations ? purchases crumbling before going to closing ? in February. That?s up dramatically from a similar poll 12 months earlier, when just 9 percent of agents reported cancellations. Another 18 percent reported delays in scheduled closings in the latest study, which involved approximately 3,000 agents surveyed by the National Association of Realtors.

The high reported cancellation rate (31 percent) doesn?t mean that nearly one of every three of all signed contracts is falling apart, according to the association, but rather that more than triple the number of agents and their clients are running into deal-endangering problems compared with 2011. If you are a potential buyer or seller in an otherwise improving marketplace, you need to be aware of the issues that are hampering sales, and be prepared in advance to deal with some of the most prominent.

Tops on the list:

? Appraisals below contract. You may assume that the true market value of a house is what a seller and buyer agree to in a binding contract, but it?s not. The appraiser hired by the bank may come up with a different opinion of value ? significantly below what was agreed between the parties ? and this is occurring with far greater frequency today than in previous years. Part of the problem is the excessive use of price-depressed foreclosure sales chosen as ?comparables? to value non-distressed houses under pending contracts. But some appraisers are inexperienced, unfamiliar with local pricing trends, and go far beyond their normal duties.

For example, Risa Bell, an agent for national brokerage Redfin in Boston, recently represented purchasers of a bank-owned property being sold ?as is.? An appraiser for the lender not only detailed a long list of needed repairs to the house, but said the deal could only proceed if the prospective buyers spent thousands of dollars fixing up the house before ? not after ? closing. Along the way, frozen pipes in the unheated house broke and a contractor hired to do repairs filed a mechanic?s lien requiring payment before the title could be transferred. All of this combined to kill the financing and torpedo the closing, but the buyers ultimately were approved by a second lender using a different appraiser, who made no such demands for repairs in advance.

Ultra-conservative underwriting and documentation requirements. It?s no longer just towering credit score minimums, hefty down payments and mind-bending paperwork submissions that get mortgage applicants turned down. ?It?s a lot of other stuff, too,? said Melissa Zavala, broker and owner of Broadpoint Properties in Escondido, Calif. Increasingly she?s been running into regulatory hoops and restrictive underwriting rules at FHA, Fannie Mae and Freddie Mac that knock signed contracts off the tracks or at least delay them for months.

For instance, FHA?s toughened rules on condominium associations ? limits on the percentage of existing residents in the entire project who are delinquent on their condo dues, plus controversial requirements for ?recertifications? of condominium developments that many condo boards find costly and burdensome in terms of legal liability ? are rendering individual units in those communities difficult to get financed, no matter how well qualified the purchasers. Little-publicized recent changes in FHA rules on loan applicants who have outstanding collection accounts buried away in their credit files ?can force you to take three to four months to clean up? through mandatory repayment plans, Zavala said in an interview. By that point the contract may well have gone bust.

? Poor service by lender staff. Agents in the survey identified ?lack of customer service? and ?generally bad attitudes? as contributing factors to delays and some contract failures. But Zavala said real estate agents themselves need to be on the ball when loan processing deadlines begin to slip or communication breaks down with lenders. ?Agents can be part of the problems? ? and the solutions ? when it comes to moving the financing along, she said.

Bottom line: If you seriously want to go to closing on a house you?re buying or selling, make sure you know all the key rules and requirements up front, then stay on top of the lending, escrow, title and real estate professionals assigned to your transaction.

And don?t give up if your deal runs into complications. There are more of them out there than usual.

'The Hunger Games' has echoes of some great films of its type: the reality-show forerunners.

The film adaptation of the first of Suzanne Collins's three "Hunger Games" novels arrives with the most sure-shot appeal of any nonsequel since "Twilight" (2008). Both target the same demographic: ages, roughly 10 to 18; gender, female; social media choice, all of them.

Unless the movie disappoints them ? and it won't ? they'll spread the good word via Twitter and Facebook and Tumblr and Pinterest or whatever it is that, unbeknownst to an older demographic, may have already supplanted them.

"The Hunger Games" takes place in a postapocalyptic America. All that remains of the United States is Panem, a 12-district federation headed by cagey President Snow (Donald Sutherland). Capitol, Panem's central city, is home to a wealthy, decadent elite, whose comforts and high-tech toys are supported by the labor of an impoverished majority. It's a social structure with echoes of "The Time Machine," "Metropolis," and John Boorman's whacked-out "Zardoz."

Having crushed a broad rebellion some 74 years ago, the government reasserts its authority over the population by staging the annual Hunger Games, a sort of gladiatorial competition-cum-reality TV show: 24 teen-agers ? one boy and one girl from each district ? are abandoned in a wilderness from which only one will be allowed to emerge alive.

Among this year's contestants is tough, resourceful Katniss Everdeen (Jennifer Lawrence) from the poorest region of all: District 12, a coal-mining area that looks a whole lot like 1930s Appalachia. Will Katniss survive? Will she be able to avoid killing Peeta (Josh Hutcherson), the other District 12 entrant, for whom she may be developing romantic feelings? Will the sun rise tomorrow?

It's tempting ? though probably foolhardy ? to look for cultural/political connections to explain the emergence and immense popularity of Collins's vision. But first you'd have to trace the social and political origins behind the rise of reality TV in the '90s ? which is the obvious inspiration for a number of similar films, including "The Truman Show" (1998), "Series 7" (2001), and "The Condemned" (2007). What sets Collins's books apart from these is the idea of the warriors being average teenagers; but even that twist has already been used in director Kinji Fukasaku's great "Battle Royale" (2000), to which "Hunger Games" has many similarities.

The real mystery is how the greatgranddaddy (and possibly best) of the genre ? Elio Petri's 1965 "The 10th Victim," starring Marcello Mastroianni and Ursula Andress ? somehow managed to predict and satirize reality TV as we know it 25 or 30 years before it existed.

Director Gary Ross ("Pleasantville," "Seabiscuit") and screenwriter Billy Ray ("Shattered Glass") ? who share the screenplay credit with Collins ? have wisely cleaved very closely to the tightly written novel. (One or two bits of exposition may be briefly confusing to those who haven't read the book.) Ross manages to keep the pacing remarkably swift, given that the games themselves don't start until halfway through the 144-minute running time.

Ross also got the casting dead right: Woody Harrelson as the alcoholic former champion who coaches Katniss and Peeta; Stanley Tucci as the broadcast's preening host; and Lenny Kravitz as the only city dweller Katniss might be able to trust. Casting Lawrence in the lead was a no-brainer, given the role's similarities to her character in "Winter's Bone," which earned her an Oscar nomination. Grade: B (Rated PG-13 for intense violent thematic material and disturbing images involving teens.)

UFC, eh? UFC will head to Canada three times in 2012

Mark your calendars, Canadian fans. The UFC announced today they will visit the home and native land of welterweight champion Georges St. Pierre three times in the remainder of 2012.

They will start in Calgary on July 21, where Jose Aldo will fight a yet-to-be-named fighter. After that, it's UFC 152 in Toronto Sept. 22, and UFC 154 in Montreal Nov. 17. St. Pierre, who was present at the press conference, announced the Montreal date.

GSP also gave an update on his health, saying he is progressing smoothly and is hoping to be back by November.

"When you get an injury like I have and you're off for a long period of time, the only thing you wish is to get back fast as possible," he said. "I don't know if it will be in the U.S. or Canada, but I wish and I pray that I have a chance to perform in 2012. No matter where it will be, I want to come back and fight in 2012."

St. Pierre is a native of Montreal, and has enjoyed great success when fighting in front of the rabid home crowd Canada can provide. His last two fights were won in Canada, and he exacted revenge on Matt Serra, one of the few men to beat him, in Montreal.

Though he isn't likely to rush his recovery from an ACL tear, he also has plenty of motivation to be ready to go on Nov. 17.

(Boston) - Researchers from the Boston University School of Medicine (BUSM) and Boston University School of Public Health (BUSPH) have conducted a study on a modified version of the Short Inventory of Problems (SIP) to help promote early intervention and treatment for patients with drug use in primary care. The findings, which validate this modified version of the SIP in a primary care setting, will appear online in the American Journal on Addictions in the March issue.

The SIP, originally designed to measure the health and social consequences of alcohol use, was adapted to create the SIP-Drug Use (SIP-DU) to assess the consequences of drug use. The SIP-DU is intended to be used by primary care physicians who can identify and intervene with drug users years before they have medical complications or seek treatment.

In the study, 106 patients from a primary care clinic at Boston Medical Center were assessed using questions from the SIP-DU. The results suggest that the SIP-DU is a valid measure of drug use consequences and compares favorably to other SIP versions. In addition, the study indicates that the SIP-DU is a brief and time-efficient screening method that could be useful in a primary care setting.

"The SIP-DU is important because there is currently a lack of validated substance use instruments available for use in primary care; most have been developed and used in specialty care settings," said lead author, Donald Allensworth-Davies, PhD, MSc, research manager of the Data Coordinating Center at BUSPH. "In the current climate of health reform and efforts to integrate substance use and medical care, tools like this are greatly needed."

According to the researchers, the purpose of this study was to validate a version of the SIP that can be used in a primary care setting for drug use consequences. When a patient is identified as using drugs, it is important to know whether they have any consequences so that any advice, counseling or referral to help the patient can be done appropriately. The researchers have used this tool in an innovative program that integrates medical, mental health and addiction care in a primary care setting.

The SIP, originally designed to measure the health and social consequences of alcohol use, was adapted to create the SIP-Drug Use (SIP-DU) to assess the consequences of drug use. The SIP-DU is intended to be used by primary care physicians who can identify and intervene with drug users years before they have medical complications or seek treatment.

In the study, 106 patients from a primary care clinic at Boston Medical Center were assessed using questions from the SIP-DU. The results suggest that the SIP-DU is a valid measure of drug use consequences and compares favorably to other SIP versions. In addition, the study indicates that the SIP-DU is a brief and time-efficient screening method that could be useful in a primary care setting.

"The SIP-DU is important because there is currently a lack of validated substance use instruments available for use in primary care; most have been developed and used in specialty care settings," said lead author, Donald Allensworth-Davies, PhD, MSc, research manager of the Data Coordinating Center at BUSPH. "In the current climate of health reform and efforts to integrate substance use and medical care, tools like this are greatly needed."

According to the researchers, the purpose of this study was to validate a version of the SIP that can be used in a primary care setting for drug use consequences. When a patient is identified as using drugs, it is important to know whether they have any consequences so that any advice, counseling or referral to help the patient can be done appropriately. The researchers have used this tool in an innovative program that integrates medical, mental health and addiction care in a primary care setting.

Estonia may crack down on human trafficking

TALLINN, Estonia (AP) ? Estonia is the only European Union country without a law about human trafficking, but legislators are expected to change that Wednesday in a vote largely prompted by concerns expressed by the United States.

Prostitution is legal in Estonia, but forced prostitution is not. Distinctions between the two are opaque in Estonian laws, according to activists, and the current penal code does not recognize sexual exploitation of a minor or forced labor as crimes.

The new legislative measures would make human trafficking a crime punishable by up to 15 years in prison.

"Despite previous commitments to pass an anti-trafficking law, the (Estonian) government and Parliament have failed to enact" such a law, Michelle Schohn, the spokeswoman for the U.S. Embassy in Estonia, said in an email to The Associated Press.

"Estonia is therefore the only country within the European Union to lack this legislation," she said, adding that trafficking offenders are rarely sentenced to prison in the Baltic state.

For this reason the U.S. State Department last year put Estonia on its trafficking watchlist, with nations such as Belarus and Russia. That stung this tiny Baltic state of 1.3 million people, which is a close Washington ally and highly sensitive to its image abroad.

The Justice Ministry has fast-tracked legislation to meet an April deadline so that Estonia could avoid being watchlisted for another year.

That admission angered Eda Molder, a therapist at MTU Eluliin, a support group for prostitutes and trafficking victims.

"We wish to see substantial changes in legislation, not cosmetic alterations. Are we writing this bill for the Americans or for the trafficking victims?" she said.

Molder is unhappy that some lawmakers have suggested milder punishments than the Justice Ministry.

Under existing law, parts of the human trafficking chain ? recruiting, transporting and exploitation ? are ignored in Estonia, and culprits walk away either with a mild sentence or a mere fine, Molder says.

The U.S. State Department report said "Estonia is a source, transit, and destination country for women subjected to forced prostitution."

It said women from rural areas are particularly at risk of being forced into prostitution in the capital, Tallinn, and in countries such as Great Britain, Finland, Germany, Italy, and the Netherlands.

Studies of children who had been exposed to methamphetamines in the womb suggest ?the drug can stunt fetal growth, increase newborn stress and cause problems with motor development. Now new research reveals that meth takes a toll on a child's mood and behavior, as well.

The new research is part of a study that tracks the babies of meth-using mothers starting at birth. Children exposed to meth in the womb are more likely to suffer from anxious and depressed moods by age 3, the researchers found. And at age 5, meth-exposed kids are more likely to "act out" behaviorally and show symptoms of attention-deficit/hyperactivity disorder (ADHD).

These mental-health findings are alarming, because behaviors seen at these young ages tend to persist, said study researcher Linda LaGasse, an assistant professor of pediatrics at Brown University.

Meth and pregnancy

Methamphetamines, sometimes known as speed or ice, are stimulants that create a feeling of energy and euphoria. According to an estimate by the Substance Abuse and Mental Health Administration in 2009, some 1.2 million Americans over the age of 12 had used meth at least once that year.

That same year, the researchers reported, 6.7 percent of people seeking treatment for methamphetamine abuse were pregnant women.

Using data from the Infant Development, Environment and Lifestyle study, which had recruited new mothers and their babies in Los Angeles, Honolulu, Tulsa, Okla., and Des Moines, Iowa, the researchers examined the behaviors of children who had been exposed to meth in utero. Mothers reported whether they'd taken meth during pregnancy, and the babies' first stools were tested for signs of meth exposure. At follow-up interviews when the children were 3 and 5 years old, the caregivers responded to questions about the children's behaviors and moods.

The study has the advantage of being from a community sample, not from women seeking help in clinics, LaGasse said. That means the women in the study are likely more representative of meth users in general. In addition, the 204 meth-exposed babies in the sample were matched with babies who had not been exposed to meth but were similar in other characteristics, including age, birth weight, insurance status and mother's education.

Meth's trajectory

At 3 years old, the children exposed to meth in the womb seemed no different from unexposed children in measures of so-called "externalizing" behaviors. These are acting-out behaviors such as bullying and other forms of aggression, and restlessness and other behaviors linked to ADHD. But by age 5, the unexposed children were maturing and showing fewer acting-out behaviors. The meth-exposed kids, on the other hand, seemed to be in a state of arrested development.

"It's like they don't make that transitional step," LaGasse said. "They're not getting worse, they're just staying."

The researchers are following up with these children to find out whether they have lost this ability to control these behaviors or if it is just delayed. But of even more concern, LaGasse said, is what the researchers found out about "internalizing" behaviors, or mood problems such as anxiety and depression. Kids exposed to meth before birth had a higher rate of these problems than unexposed kids at age 3, and that difference persisted to age 5.

"That's actually very worrisome, and why it's so worrisome is that this kind of behavior can slip through the net," LaGasse said. "It's not disruptive, it's not going to be as upsetting to parents. ? It?s not going to come up as much in a pediatric visit."

The good news, LaGasse said, is that young children aren't set "hard and fast" in their ways. Early mental-health and parenting interventions have the potential to interrupt the path that meth put these children on.

"This is an opportunity," LaGasse said. "The importance here is catching these things early and redirecting the trajectory of this child."

The new iPad looks just like the old iPad: a 9.7-inch screen surrounded by a black (or white) bezel, with a curved metal back, and a single Home button. Apple's magnetic Smart Cover, which was released with the iPad 2,?clips on just fine. The tablet still has a sealed-in battery and no ports other than a MicroSIM slot, a standard headphone jack, and an Apple 30-pin dock connector.

If you look closely, you'll notice that at 7.3 by 9.5 by .37 inches (HWD) and 23.3 ounces, it's just a hair thicker and a smidge heavier than the iPad 2, but you wouldn't notice if you weren't holding both tablets at once. The additional weight is because of a much larger battery, although the new iPad promises the same battery life as the previous model?the 4G radio and sharper screen are just much more power hungry.

With a decent signal, our test iPad pulled down 10-11Mbps, which is about the national average download speed we measured for Verizon in our Fastest Mobile Networks story.

Buying a 4G tablet means signing up for an?iPad data plan?and staying under your data cap. That's one way iOS falls short.? There's a data counter, but it's buried under Settings>General>Usage>Cellular Usage, which is just too deep to monitor regularly. Verizon sends messages when you're about to run out of data, but that's almost too late. Invest instead in Sigterm's 99-cent Data Usage app and stick it on your first home screen; it keeps constant track of how much cellular data you've used by floating a percentage over its icon.

Processing Power and Battery Life
The new iPad's A5X processor, a dual-core Cortex-A9 running at 1GHz, is the same CPU as in the previous iPad, with a better GPU to handle the higher-resolution screen. In tests we saw similar performance, with both the Geekbench processor/memory benchmark (at 761) and Rightware's Browsermark benchmark (at 102,096) falling very close to the scores for the iPad 2.

According to Apple, the new GPU offers "four times the performance" of the iPad 2, which turns out to mean that it offers the same performance while pushing four times the pixels. In the GLBenchmark 2.1.2 "Egypt High" test, which creates a simulated 3D game scene, the iPad 2 and new iPad had almost exactly the same frame rate of 28 frames per second?but remember, the new iPad has to work four times as hard to get there. The "Egypt Offscreen" test, which takes displaying actual pixels out of the equation, drew 50 percent more frames on the new iPad than the iPad 2, highlighting the additional graphics power.

But benchmarks have never been a good measure of the iPad user experience, because there's a lot of clever programming involved. Apple prioritizes user input, which means buttons respond quickly and scrolling and zooming are always smooth. That programming, rather than raw CPU speed, is why iPads feel faster than Android tablets.

App developers may be pushing the limits of the A5's power, though. In the Retina-display-enhanced Barefoot Atlas and Real Racing 2 HD apps, I saw occasional stutters when zooming or rotating complex, rendered objects. This didn't occur in on-board apps such as the Safari Web browser or the video player.

I'm testing the battery right now, but Apple estimates the 42.5-watt-hour cell will deliver 10 hours of usage time on Wi-Fi and 9 hours on 4G, which is very good for a large-screen tablet. We'll see.
